Across the United States, civil forfeiture has become a valuable tool for fighting crime.

Allowing law enforcement officers to seize the property of dangerous criminals helps diminish their opportunity to commit more crimes, especially in drug-dealing and organized-crime cases.

District 48 State Senator Mark Messmer of Jasper says however, it is also important to protect the property rights of innocent individuals.

This session, the Indiana General Assembly passed Senate Enrolled Act 99 to help balance these two goals. Messmer says this legislation is the product of months of research and work by a 2017 interim study committee…..

Finally, Messmer says Senate Enrolled Act 99 creates a new procedure to protect the rights of a property owner if the owner was not in possession of the property at the time it was seized.
