The man convicted of killing an Indiana University student in 2000 has been ordered to be released from prison.

U.S. District Court Judge, James Sweeney of Indianapolis, ruled that John Myers’s trial was so ineffective that it violated Myers’s Sixth Amendment rights.

He orders for Myers to be released within a 120-day span unless prosecutors choose to retry him.

Myers, now 43-years-old was convicted and sentenced to 65 years for killing 19-year-old Jill Behrman in 2006.

Behrman disappeared after leaving her Bloomington home for a bike ride in May 2000.

Hunters found her remains 3 years later in Morgan County.

Morgan County Prosecutor Steve Sonnega tried the case. Sonnega says he’s disappointed in the ruling. Before deciding to pursue a new trial, Sonnega says he will discuss it with Behrman’s family and Indiana’s Attorney General.
