A southern Indiana judge is scheduled to hear arguments next month on whether the trial of a man accused of driving while intoxicated in a deadly crash should be moved to another county because of media attention.

Daniel Moon, the attorney for James Allen, told Gibson County Superior Court Judge Earl Penrod last week he plans to request a change of venue. Chief Deputy Prosecutor Sharon Werne says she intends to oppose the motion.

Penrod scheduled a hearing for Jan. 6.

Allen faces numerous charges for a crash involving a 16-passenger van that was carrying 22 people in September when it overturned on Interstate 69 killing two people.

Allen remains in custody at the Gibson County Jail on $5,000 bond.
