Dubois County Prosecutor Beth Schroeder has filed a request with the Dubois Superior Court for the appointment of a special prosecutor to investigate allegations of inappropriate spending of commissary funds by the Dubois County Sheriff’s Office.

Under Indiana Code 33-39-10-2, various grounds exist for appointing a special prosecutor. In this case, subsection (b)(3) provides that a circuit or superior court judge may appoint a special prosecutor if: (A) the prosecuting attorney files a petition requesting the court to appoint a special prosecutor; and (B) the court finds that the appointment is necessary to avoid the appearance of impropriety.

Prosecutor Schroeder stated, “Given that Sheriff Kleinhelter and I are both elected officials in Dubois County, out of an abundance of caution and to avoid the appearance of impropriety, I have filed a petition requesting that an independent prosecutor be appointed to investigate the allegations.”

Prosecutor Schroeder made this request last Wednesday, July 31, 2024, and is awaiting the appointment of a special prosecutor at this time. Any questions or comments from the public regarding this investigation should be directed to the appointed special prosecutor.
